TERMS, CONDITIONS & PRIVACY POLICY

This document is the complete agreement between you and Whole Body Brain, LLC and applies to all services and products. By purchasing or enrolling in any Whole Body Brain, LLC service or product, you confirm that you have read, understood, and agreed to all terms below.

PART 1: TERMS AND CONDITIONS & DISCLAIMER
Applies to All Services and Products
1. NON-MEDICAL SERVICES
Whole Body Brain, LLC provides educational coaching and nutritional consulting related to nutrition, brain health, and wellness. All services and materials are educational in nature. They are not medical care and do not constitute medical advice, diagnosis, or treatment.
Practitioners associated with Whole Body Brain, LLC are not licensed medical providers. Services do not diagnose or treat illness, prescribe medications or therapies, or replace the care of a licensed healthcare provider. Discussion of laboratory data, supplements, or lifestyle strategies is provided for educational purposes only.
By participating, you acknowledge that no physician-patient, dietitian-patient, therapist-client, or other licensed healthcare relationship is created. If you are under the care of a licensed provider, you are encouraged to share relevant information with them and consult them before making significant changes to your health regimen.
2. CLIENT RESPONSIBILITIES AND DECISION AUTHORITY
Participation is voluntary and may be discontinued at any time. You retain full responsibility for all health decisions, including those related to diet, supplements, lifestyle, and medical care. Recommendations are educational suggestions you may accept, modify, or decline. Whole Body Brain practitioners will not advise on medication changes.
You agree to provide accurate health information, communicate relevant changes in your health, maintain appropriate medical supervision when needed, and consult a licensed provider before making significant changes when a medical condition exists.
3. ASSUMPTION OF RISK
Dietary, lifestyle, and supplement changes may involve inherent risks and produce varying individual responses. By participating, you voluntarily assume full responsibility for outcomes associated with implementing recommendations. You agree to discontinue any strategy causing concerning symptoms and seek appropriate medical care when necessary.
4. COMMUNICATION AND EMERGENCY POLICY
Communication outside of scheduled sessions is intended for administrative purposes and brief coaching support only. Whole Body Brain, LLC does not provide medical monitoring, emergency services, or real-time supervision. Clients agree not to rely on messaging for urgent or medical concerns and to contact emergency services or a licensed provider in a medical emergency.
5. TELEHEALTH AND REMOTE SERVICES CONSENT
Services may be delivered via video conferencing, phone, or digital platforms. By participating, you acknowledge that electronic communication carries inherent privacy and technology risks, that occasional disruptions may occur, and that no platform can guarantee absolute confidentiality. You consent to receiving services through remote communication methods.
6. RECORDKEEPING
Session notes are practitioner documentation, not medical records. Coaching documentation may differ from clinical standards. Records may be retained as required for business, legal, or insurance purposes.
7. INTELLECTUAL PROPERTY
All materials provided by Whole Body Brain, LLC -- including courses, videos, audio, written content, worksheets, frameworks, protocols, and digital downloads (Materials) -- are the exclusive intellectual property of Whole Body Brain, LLC. No ownership rights are transferred through purchase or participation. You receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial educational use only.
You agree not to copy, reproduce, share, distribute, upload, or use Materials for any teaching, training, clinical, or commercial purpose, and not to modify or create derivative works. Unauthorized use may result in termination of access without refund and legal action to the fullest extent permitted by law. All rights not expressly granted are reserved.
8. RELEASE OF LIABILITY AND LIMITATION OF DAMAGES
To the fullest extent permitted by law, you accept full responsibility for health and lifestyle decisions made in connection with your participation. Whole Body Brain, LLC shall not be liable for outcomes resulting from client-directed implementation of educational recommendations, nor for indirect, incidental, consequential, or special damages. If liability is found to exist, total liability shall not exceed the amount paid for the services giving rise to the claim.
9. DISPUTE RESOLUTION AND GOVERNING LAW
This agreement is governed by the laws of the State of Texas. Disputes shall first be submitted to good-faith informal resolution, then mediation if unresolved, and finally to binding arbitration as the exclusive remedy, except where prohibited by law.
10. GENERAL PROVISIONS
This agreement constitutes the entire understanding between the parties. You have not relied on any representations not expressly contained herein. If any provision is found unenforceable, all remaining provisions remain in effect.

PART 2: PURCHASE TERMS
Applies to All Services and Products
PAYMENT
Payment is required in full at the time of purchase or enrollment unless an approved payment plan has been established. Failure to complete payment may result in suspension or termination of access to services and materials.
REFUND POLICY
Refund terms vary by service type and are specified in the purchase terms presented at checkout for each product. If you have a question or concern about your purchase, please contact Whole Body Brain, LLC directly at www.thewholebodybrain.com/contact.
SCHEDULING AND SESSION COMPLETION
For session-based services, sessions are scheduled through the designated booking platform. Sessions may be rescheduled or cancelled with at least 24 hours written notice. Cancellations submitted with less than 24 hours notice and no-shows may be forfeited in accordance with the purchase terms for the service enrolled in. Session completion windows and expiration policies are specified in the purchase terms presented at checkout.
Prior to the first session, clients are asked to complete an intake form. Where applicable, preparation may also include advance review of existing health documents or coordination with a supervising practitioner.
DIGITAL ACCESS AND TECHNICAL REQUIREMENTS
Access to digital content requires internet connectivity, a compatible device and browser, and a functioning email address. Access duration varies by service and is specified at the time of purchase. Whole Body Brain, LLC is not responsible for access limitations caused by personal technology, internet service issues, or third-party platform outages. Access will not be extended in the event of platform changes outside Whole Body Brain, LLC's control.
GROUP PROGRAM RECORDING CONSENT AND PARTICIPATION
Live group sessions may be recorded by Whole Body Brain, LLC and made available to enrolled participants within the designated platform. By enrolling in a group program, you consent to being recorded during live sessions in which you may appear or speak. Recording of sessions by participants is not permitted. Participants agree to engage respectfully, maintain confidentiality regarding personal information shared by other group members, and not share or distribute session content outside the platform.
CLIENT RESPONSIBILITIES
Across all service types, clients agree to participate at their own discretion, implement or decline recommendations based on personal judgment, communicate relevant changes in health status, and maintain appropriate medical supervision where applicable. Results are not guaranteed and depend on individual participation.
MATERIALS
All materials provided in connection with any service are subject to the intellectual property terms in Part 1, Section 7 of this agreement.

PART 3: PRIVACY POLICY

INTRODUCTION
Whole Body Brain, LLC is committed to protecting your personal information. This Privacy Policy describes what information we collect, how we use it, with whom we share it, and the rights you have regarding your data. It applies to all services, products, and use of the Whole Body Brain website (thewholebodybrain.com).
By using our website or purchasing a service or product, you agree to the practices described in this Privacy Policy.
1. INFORMATION WE COLLECT
We may collect the following categories of personal information:
- Contact information, including name, email address, phone number, and mailing address

We collect information you provide directly, as well as information collected automatically when you visit our website or use our platforms.

3. THIRD-PARTY SERVICE PROVIDERS
We use third-party platforms to operate our business. These providers may receive limited personal information as necessary to perform their services on our behalf. Our primary platform is Kajabi, which we use for course hosting, community, email communication, and payment processing. Kajabi's privacy practices are governed by Kajabi's own privacy policy, available at kajabi.com. We may also use tools for video conferencing, appointment scheduling, or other business operations. These providers are selected with data practices in mind and are not permitted to use your information for purposes beyond supporting Whole Body Brain, LLC's operations.
4. COOKIES AND TRACKING
Our website and hosted platforms use cookies and similar tracking technologies to support website functionality, analyze traffic, and improve user experience. You may adjust cookie preferences through your browser settings; however, disabling cookies may affect the functionality of certain features. We do not currently respond to Do Not Track signals.
5. DATA SECURITY
We take reasonable measures to protect your personal information from unauthorized access, disclosure, or misuse. However, no internet transmission or electronic storage system is entirely secure, and we cannot guarantee the absolute security of your data.
6. DATA RETENTION
We retain personal information for as long as necessary to fulfill the purposes described in this policy, maintain business records, and meet legal obligations. Health information provided in the context of coaching services is retained in accordance with the recordkeeping practices described in Part 1, Section 6 of this agreement.
7. YOUR RIGHTS
You have the right to request access to the personal information we hold about you, request correction of inaccurate information, request deletion of your information where legally permitted, and opt out of marketing communications at any time using the unsubscribe link in any email we send.

8. CHILDREN'S PRIVACY
Our services and website are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided personal information to us, please contact us and we will take appropriate steps to remove it.

We may update this Privacy Policy from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of our services or website following any update constitutes acceptance of the revised terms.
